umihosting.com provides an internet domain name registration and hosting service. umihosting.com reserves the right to suspend or cancel a customer's access to any or all services provided by umihosting.com when umihosting.com decides that the account has been inappropriately used or otherwise.

Free hosting

In addition to other terms, the free hosting implies these regulations.
Content linking for download originating from external servers are not allowed on free hosting. You can keep files for download on free servers but they must only be accessed from web pages hosted on the same account.

File sharing by Ftp is strictly prohibited. Only html downloads are allowed.
Dead websites will be deleted. Any website that does not receive any hits over a period of 3 months will be considered dead.

Free service is regularly monitored to assure commercial grade service and monitor regulations.
Free hosting is available for all countries with regional language support on request.

Domain Name Registration

We make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name. You should therefore not assume registration of your requested domain name(s) until you have been notified that it has or they have been registered. Any action taken by you before such notification is at your risk.

The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant naming authority; you shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name. More information can be found here at icann 

We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant naming authority but will not be obliged to take part in any such dispute.

We shall not release any domain to another provider unless full payment for that domain has been received by us.

Domain & Reseller Hosting

umihosting.com reserves the right to refuse service and /or access to its servers to anyone.

umihosting.com do not allow any of the following content to be stored on its servers:

Illegal Material - any material which constitutes, or encourages the commission of, a criminal offence or which infringes any patent, trade mark, design right, copyright or any other intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of umihosting.com. Also includes any sites which provide "links to" information about such material or advertising for such material.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

umihosting.com prohibits using the server as a file storage for commercial distribution requiring unacceptable usage of bandwidth. This includes MP3, software or any other type of files.  You may store files if you are not draining too much resources. Streaming media is not allowed on any of our servers.

Sending unsolicited emails using our server is strictly prohibited. This is considered illegal and will cause your account [Mail/Web] to be suspended or permanently disabled. Running IRC or chat scripts on the server is also prohibited.

UNLIMITED USE POLICY

Applicable to plans using unlimited resources. High bandwidth usage: umihosting.com offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, umihosting.com may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, umihosting.com reserves the right to impose the High Resource User Policy for the consideration of all customers.

HIGH RESOURCE USER POLICY

Resources are defined as bandwidth and/or processor utilization. umihosting.com may implement the following policy to its sole discretion: When a website found to be monopolizing the resources available, the account holder will be contacted in order to discuss the situation. If no arrangement can be reached, umihosting.com reserves the right to terminate the account.

CANCELLATION

umihosting.com reserves the right to cancel service at any time.

INDEMNIFICATION

Registered user agrees that it shall defend, indemnify, save and hold umihosting.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against umihosting.com, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless umihosting.com against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with umihosting.com's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from umihosting.com's server.

umihosting.com will not be responsible for any damages your business may suffer. umihosting.com makes no warranties of any kind, expressed or implied for services we provide. umihosting.com disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by umihosting.com and its employees. umihosting.com reserves the right to revise its policies at any time.
